What rights do I have?
The Fourth Amendment of the United States Constitution states that every citizen has the right to be free from illegal searches and seizures. If it is shown that the search and/or seizure of the contraband is illegal, the judge will dismiss your case.
The officer began the search without my permission, what can I do?
In most situations before the officer searches a car, a bag, or even pats a person down for weapons the officer must be able to state specific reasonsfor the searchor the whole arrest and search is illegal. Most people do not know that in most situations the officer must receive consent from the person before beginning a search. Most defendants do not realize that they can refuse most searches that the officers conduct. The best thing that a person can do after being arrested after what they think is an unlawful arrest and/or search is to contact an attorney who has been successful in winning these cases. I have been successful in winning a number of these cases by showing the Courts that my clients were illegally stopped and searched.
My arrest was probably illegal, but I can't afford to fight, so I might as well take a plea.
